NOTICE IS HEREBY GIVEN, as required by and in compliance with Section 147(f) of the Internal Revenue Code of 1986, as amended (the “Code”), that, commencing at 7:00 p.m., or as soon thereafter as the matter may be heard, on October 2, 2024 a public hearing will be held before the City Council of the City of San Luis in the City Council Chambers, San Luis City Hall, 1090 E. Union Street, San Luis, Arizona 85336, for the purpose of providing an opportunity for interested persons to express their views, orally and in writing, with respect to the proposed issuance by The Industrial Development Authority of the City of San Luis, Arizona (the “Issuer”) of debt (the “Subject Debt”) in the maximum stated principal amount of $80,000,000, in one or more series and/or issuances from time to time pursuant to a plan of finance.

The proceeds of the Subject Debt are to be lent to Regional Center for Border Health, Inc., an Arizona nonprofit corporation and an organization described under Section 501(c)(3) of the Code (the “Borrower”).

The Borrower proposes to use the proceeds of the Subject Debt as part of a plan of finance to (i) design, construct and equip a new approximately 16-bed hospital in San Luis, Arizona, to be known as the “Border Health Medical Campus/San Luis Community Hospital” (the “Project”), which is expected to be approximately 64,000 square feet in size and to be constructed on a 10-acre parcel owned by the Borrower with an anticipated street address of 311 South Oak Avenue, San Luis, AZ, 85349, which is adjacent to the Borrower’s existing Medical Mall facilities located at 151 South Oak Avenue, San Luis, AZ, 85349 (all of the property to be financed with proceeds of the Subject Debt is collectively referred to herein as the “Financed Property”); (ii) pay certain costs associated with the issuance of such debt; and (iii) fund a reserve fund and pay capitalized interest, if applicable.  The initial owner and principal user of the Financed Property will be the Borrower.

All or a majority of the Subject Debt is expected to be issued as tax-exempt qualified 501(c)(3) bonds as defined in Section 145 of the Code.

The Subject Debt will be a special, limited obligation of the Issuer and will not constitute a debt or pledge of the full faith and credit of the Issuer, the City of San Luis, the State of Arizona or any agency or political subdivision thereof.  The Subject Debt is to be secured by a pledge of and lien on the revenues generated by the Borrower’s healthcare operations (less operating expenses), which is to be on a parity with the lien of the Borrower’s previously authorized and currently outstanding loans made by the United States Department of Agriculture (“USDA”).  USDA’s written consent is required prior to the issuance of any parity obligations with the outstanding USDA financings and, as of the date of this Notice, the Borrower is actively working with USDA to obtain such consent.

NOTICE IS HEREBY GIVEN that, on behalf of the City of Yuma and the City of San Luis, Arizona, on August 21, 2024 a public hearing will be held by a representative for The Industrial Development Authority of the City of Yuma, Arizona (the “Issuer”), regarding the proposed issuance by the Issuer of its qualified 501(c)(3) bonds as defined in Section 145 of the Internal Revenue Code of 1986, as amended (the “Code”) for healthcare facilities in one or more series from time to time pursuant to a plan of financing (the “Bonds”), in an aggregate principal amount not to exceed $310,000,000.

The proceeds from the sale of the Bonds will be loaned to Yuma Regional Medical Center, Inc. (the “Corporation”), an Arizona nonprofit corporation and an organization described in Section 501(c)(3) of the Code for the following purposes (collectively, the “Projects”): 

(1) An amount not exceeding a maximum aggregate principal amount of $50,000,000, to refund all or a portion of certain prior bonds issued by the Issuer, on behalf of the Corporation, the proceeds of which were used to finance and/or refinance, costs of construction, improvements and renovations to and equipping of, hospital and other health care and support facilities owned by the Corporation, generally located at the following addresses: (i) 2400 South Avenue A, Yuma, Arizona 85364; and (ii) 1320 West 24th Street, Yuma, Arizona 85364.

(2) An amount not exceeding a maximum aggregate principal amount of $260,000,000 to finance, including reimburse for, and/ or refinance costs of the acquisition, improvement, renovation and equipping, including capitalized interest, of hospital and other health care and support facilities owned by or to be owned by the Corporation, generally located at the following addresses: (i) 2400 South Avenue A, Yuma, Arizona 85364 (principal amount not to exceed $180,000,000); (ii) Southeast corner of West 24th Street and Avenue A, Yuma, Arizona 85364 (principal amount not to exceed $60,000,000); (iii) 7214 East 31st Place, Yuma, Arizona 85365 (principal amount not to exceed $15,000,000), (iv) Southwest corner of County 22nd Street and Main Street, San Luis, Arizona 85349 (principal amount not to exceed $60,000,000) and (v) Southeast corner of County 24th Street and Avenue E, San Luis, Arizona 85349 (principal amount not to exceed $40,000,000).

The Bonds shall constitute special limited obligations of the Issuer.  The principal of, premium (if any), and interest on the Bonds shall never constitute the debt or indebtedness, or a liability, of the Issuer, the City of Yuma (the “City”) or the State of Arizona (the “State”) or any political subdivision of the State within the meaning of any provision of the Constitution of the State and shall not constitute nor give rise to a pecuniary liability or a charge against the general credit or taxing powers of the Issuer, the City, or the State or any political subdivision of the State, but shall be payable solely from the sources provided for in the proceedings for the issuance of the Bonds.  The Issuer has no taxing power.

The City of San Luis is expected to receive approximately $466,638.00 in FY 2024 federal CDBG funds from the Arizona Department of Housing Regional Account (RA). The City of San Luis also intends to apply for $750,000.00 in FY 2024 CDBG funds from the State special projects (SSP) account. CDBG funds must be used to benefit low-income persons and areas, alleviate slum and blight or address urgent need. Based on citizen input as well as local and state planning objectives several potential projects have been selected to be forwarded to the State of Arizona with a request for funding. A public hearing will be held at the regular City Council meeting at 6:00 PM on 06/26/2024 at San Luis City Hall, 1090 E. Union Street, San Luis, AZ 85349 to discuss the potential projects.   It is expected that the City Council will select the final project(s) at this hearing and adopt applicable resolutions. The potential CDBG projects(s) are named and described as follows: 

 1. Se espera que la Ciudad de San Luis reciba aproximadamente $466,638 en fondos federates CDBG para el afio fiscal 2024 de la Cuenta Regional (RA) del Departamento de Vivienda de Arizona. La Ciudad tambien tiene la intencion de solicitar $500,000 (aproximadamente) en fondos CDBG para el año fiscal 2024 de la Cuenta de Proyectos Especiales del Estado (SSP, por sus siglas en ingles).

Los fondos CDBG deben utilizarse para beneficiar a personas y areas de bajos ingresos, aliviar los barrios marginales y el deterioro, o abordar necesidades urgentes. El 23 de mayo de 2024, a las 6:00 p.m., se llevara a cabo una audiencia publica en el Salon de Conferencias Pedro Julian del Ayuntamiento de San Luis, ubicado en 1090 E. Union Street, San Luis, AZ 85349 para recopilar la opinion de los ciudadanos sobre el uso de los fondos CDBG. Algunos ejemplos de posibles usos son los siguientes:

1. Infraestructura Pública (por ejemplo: agua, aguas residuales, mejora de calles);
2. Instalaciones de la comunidad (por ejemplo: parques, áreas de juego, centro comunitario, centro de personas mayores, bancos de alimentos, instalaciones para personas sin hogar, refugios de violencia doméstica, residencias intermedias, viviendas para víctimas de desastres);

Pursuant to A.R.S. § 9-499.15, the City of San Luis, Arizona, hereby gives notice that it may adopt a resolution to impose new or increased fees and will post on the city’s website a copy of the proposed new or increased fees. The fees to be adopted and/or increased are Equipment and Personnel and Local Law Enforcement; Video Recording Fees.

LOCAL LAW ENFORCEMENT; VIDEO RECORDINGS; FEE

Except as provided in section 39-127, a county, a city, a town or any political subdivision of this state may establish a onetime fee per copy, not to exceed $46.00 per video-hour reviewed, that is charged to a person who submits a public records request to a local law enforcement agency for a copy of a video recording.  A county, a city, a town or any political subdivision of this state may take into consideration the following information when determining the amount of the onetime fee per copy: EQUIPMENT AND PERSONNEL.  In addition to the fee for materials, the City may charge a fee of $19.04 per hour to reimburse the City for the cost of equipment and personnel, used in producing copies of the records or in converting the records into read-only electronic format, but not for the cost of searching for the records.

Current Fee - $19.04  Proposed Fee - $23.72

The City of San Luis Council will consider approving these proposed fees after a Public Hearing to be held on June 12, 2024, in the Council Chambers, 1090 E. Union Street, San Luis, Arizona, as part of the Council meeting scheduled to begin at 6:00 pm.

THE ABOVE FEES WILL BECOME EFFECTIVE THIRTY (30) DAYS AFTER APPROVAL BY THE CITY COUNCIL.

Copies of the fee schedule for the new or increased fees may be reviewed at the City Clerk’s Office of the City of San Luis, 1090 E. Union Street, San Luis, Arizona 85349, during normal office hours, Monday through Friday, 7:00 a.m. – 6:00 p.m. The proposed fee schedule is also available on the San Luis website at www.sanluisaz.gov 

Persons wishing to comment on the proposed changes may do so, in writing, prior to the public hearing to be held on the date listed above, or may testify in person at the hearing. After the public hearing of June 12, 2024, the City Council may approve, disapprove, or modify said resolution.
